This privacy policy applies to the website muema.com and to all services offered by Muema.

We process your personal data in accordance with the General Data Protection Regulation (GDPR) of 27 April 2016 and the Belgian Act of 30 July 2018 on the protection of natural persons with regard to the processing of personal data.

2. What personal data do we process?

We only process personal data that is necessary for our services and for the purposes described below. Specifically, we process the following categories:

2.1. Identification and contact details

First name, last name, company name, job title, e-mail address, phone number, site address, invoicing address.

2.2. Project data

Type of project, surface area, completion date, scope of works, drawings, photos or attachments you send us.

2.3. Financial and administrative data

VAT number, company registration number, bank account number (for payments), invoicing details and payment history.

2.4. Communication data

Content of e-mails, correspondence, meeting notes and all other correspondence you have with us.

2.5. Technical data (website visits)

IP address, browser type, operating system, pages visited, duration of the visit, referring website. This data is mainly collected via cookies (see item 9).

3. Why do we process your personal data?

We process your personal data exclusively for the following purposes:

drawing up and sending quotes;
performing the agreement and the contracted services;
managing customer relationships and project communication;
invoicing, payments and bookkeeping;
complying with legal obligations (tax, social, administrative);
following up complaints or disputes;
improving our website and services;
sending business communications to existing customers (relevant news, follow-up questions);
statistical analysis of website visits.

4. On what legal basis do we rely?

We process your personal data on the basis of one or more of the following legal grounds:

Performance of the contract: for drawing up quotes, carrying out works and managing the customer relationship.
Legal obligation: for tax obligations, bookkeeping, social legislation (including site presence registration 30bis, Limosa).
Legitimate interest: for the proper functioning of our business, customer administration, fraud prevention, security and sending business communications to existing contacts.
Consent: for placing certain cookies and for specific communications you have signed up for. You can withdraw this consent at any time.

5. How long do we retain your data?

We do not retain your personal data longer than strictly necessary for the purposes for which it is processed. Specific retention periods:

Quotes without follow-up: 2 years from the date of the quote;
Customer data and project files: 10 years after the last service (in line with the statutory limitation period for construction contracts);
Invoicing and accounting data: 7 years (statutory tax retention obligation);
Social law documents: according to statutory retention periods;
Website visit data: maximum 26 months;
Job applications: maximum 2 years after the recruitment process, subject to consent.

Once the retention period has expired, the data is deleted or anonymised.

6. With whom do we share your personal data?

We do not sell your personal data to third parties. We only share your data with third parties to the extent necessary to perform our services or to comply with legal obligations. Specific categories:

Subcontractors and partners engaged on your project (only the data required for the works);
IT service providers (hosting, e-mail, CRM, forms) acting as processors and bound by a data processing agreement;
Accountant, payroll office and auditor;
Insurers in the event of a claim;
Competent authorities where legally required (tax authorities, social security, judicial authorities);
Legal advisers or lawyers in the event of disputes.

All external processors are carefully selected and contractually required to treat your data confidentially and protect it in accordance with the GDPR.

Your data is in principle not transferred outside the European Economic Area (EEA). Should this nevertheless be necessary, we will ensure appropriate safeguards (such as the European Commission's standard contractual clauses).

7. How do we secure your data?

We take appropriate technical and organisational measures to protect your personal data against loss, misuse, unauthorised access or unlawful processing. These measures include:

secure storage of digital data;
access control and password management;
regular back-ups;
encrypted connections (SSL/TLS) on our website;
confidentiality obligations for employees and subcontractors.

Should a data breach nevertheless occur, posing a potential risk to your rights and freedoms, we will inform you and the Data Protection Authority within the statutory time limits.

8. What rights do you have?

Under the GDPR, you have the following rights:

Right of access — you may ask which personal data we process about you;
Right to rectification — you may have inaccurate or incomplete data corrected or completed;
Right to erasure ("right to be forgotten") — you may ask us to delete your data, insofar as we have no legal obligation to retain it;

Right to data portability — you may receive your data in a structured, commonly used format;
Right to object — you may object to processing based on legitimate interest;
Right to withdraw consent — where processing is based on your consent, you may withdraw it at any time;
